These terms of sale are concluded on the one hand by SAS Diag-Engine, with its registered office at ZAC Maison Rouge 27800 BOSROBERT, SAS with a capital of 3,000 Euros - SIREN: 810 169 573 - RCS Bernay, and on the other hand, by any individual or legal entity wishing to make a purchase or receive a service.
OBJECT
These terms of sale define the contractual relations between SAS Diag-Engine and the buyer. The purchase of a product or service through our company implies an unconditional acceptance by the buyer of these terms of sale.
These terms of sale shall prevail over any other general or special conditions not expressly agreed to by SAS Diag-Engine. Diag-Engine reserves the right to modify its terms of sale at any time.
In this case, the applicable conditions shall be those in effect on the date of the order by the buyer. Characteristics of the goods and services offered The products and services offered are those listed in the catalog published on the Diag-Engine website. To avoid any issues during the shipment of the ABS block, you must ensure the accuracy and completeness of the mandatory data you provide. Diag-Engine guarantees the proper functioning of the supplied ABS block, regardless of the indicated reference or the visual appearance of said ABS block.
RATES
The prices indicated on the website are inclusive of taxes, applicable on the day of the order. We reserve the right to change our prices at any time, the price indicated on the day of the order will be the only one applicable to the buyer. The prices indicated include order processing, transportation, and delivery costs.
ORDERS
The buyer who wishes to place an order for a product or service must:
- Place an order on the website, validate the terms and conditions of sale.
- Make the payment under the specified conditions.
- In the case of a repair service, send us the original ABS block along with the invoice in the package.
WITHDRAWAL
All withdrawal requests must be made within the legal period of 14 days by email.
The withdrawal period is 14 days from receipt of your order, however, due to the nature of the product, programming and preparation fees of 90 Euros including VAT will be deducted.
PAYMENT TERMS
The price is due at the time of order.
DELIVERIES
Deliveries are made to the address provided by the buyer via Colissimo within 48 hours.
In case of damage during transport, a claim must be filed with the carrier within three days of delivery. Delivery times are indicative only.
WARRANTY
All services and products provided by Diag-Engine on the Univers-abs.fr website are covered by a 2-year warranty.
All warranty claims must be made by email. As part of the warranty claim, the buyer is responsible for returning the ABS unit at their own expense, and Diag-Engine cannot be held responsible for any dismantling, reassembly, or programming costs.
In the case of a standard exchange, the codes and options reprogrammed in the ABS unit are those present in the buyer's original ABS unit. These codes and options may have been degraded and modified by the ABS unit failure, and no claims can be made regarding this matter.
All our ABS units come with a warranty mark. The warranty does not apply in the following cases:
- Damaged warranty mark
- Testing the ABS unit on a vehicle other than the one designated by the registration document
- Failure to provide a diagnostic report issued by a dealer of the vehicle's brand or, alternatively, a multi-brand garage using a multi-brand diagnostic tool.
- Any physical or electrical damage caused intentionally or unintentionally
RESPONSIBILITIES
The seller is only bound by an obligation of means; their liability cannot be incurred for damage resulting from the improper use of an ABS block.
Diag-Engine reserves the right to cancel an order in case of prolonged unavailability of repair parts or exchange calculators.
INTELLECTUAL PROPERTY
All elements of the Diag-Engine website are and remain the intellectual and exclusive property of Diag-Engine. No one is authorized to reproduce, exploit, distribute, or use in any way, even partially, elements of the site whether they are software, visual, or sound. Any simple or hypertext link is strictly prohibited without the express written consent of Diag-Engine. Personal Data In accordance with the law on data processing, data files, and individual liberties of January 6, 1978, personal information about buyers may be subject to automated processing. Diag-Engine reserves the right to collect information about buyers, including the use of cookies, and, if desired, to transmit the collected information to commercial partners. Buyers can object to the disclosure of their contact details by notifying Diag-Engine. Similarly, users have the right to access and rectify data concerning them, in accordance with the law of January 6, 1978.
DISPUTE RESOLUTION
These online sales conditions are subject to French law. In case of dispute, jurisdiction is granted to the competent courts of Evreux, notwithstanding a plurality of defendants or third-party proceedings.
